Guam - Andersen Air Force Base has requested a permit from the Guam Environmental Protection Agency (EPA) to operate their open burn / open detonation (OB/OD) range as a permitted hazardous waste management facility. The Air Force is seeking the permit to treat UXO, waste ammunition, and waste explosives through open detonation.
The range was originally constructed in 1962, before there was a regulatory requirement for a permit. The base originally applied for a permit in 1993, but it has been delayed a number of times. Since then all detonation actions were performed for either training or emergencies; which are two activities exempted from regulatory permitting. The permitting of OB/OD ranges dates back to the late 1980s when the EPA and authorized states required installations to apply for a permit under the Resource Conservation and Recovery Act (RCRA) program. To date, the permitting process across DoD has not been consistent. For starters, many installations did not apply for a permit. Of the installations that did apply, only a very few have received their final permits, some have withdrawn their applications, while the majority of them were granted interim status. Going through the permitting process can be expensive. Installations receiving final permits have spent as much as $1M to go through the process. Several installations have spent even more and remain in interim status. Permitting costs are often driven by the expenses associated with characterizing the extent of potential soil and/or groundwater contamination.
The permitting process is just the first step. Permitted facilities are often subject to reoccurring groundwater and/or soil monitoring, permit fees and maintenance fees. Upon closure of the OB/OD unit, the facility must comply with the RCRA closure requirements established by the EPA or authorized state.
The permit for Anderson Air force Base has been drafted and is currently out for public comment.

HALIFAX, Nova Scotia -- The British Navy plans on conducting underwater surveys for UXO and ammunition at five separate sites off of Cape Breton. The UXO and ammunition were discarded by Naval ships returning from WWII. Upon returning, the ships were ordered to dump their surplus ordnance near the edge of the Laurentian Channel. The Navy plans to use a contractor to conduct the side-scan sonar surveys of the area which is between 450 to 650 feet deep. An underwater remote-operated vehicle will be used to check out anything suspicious. Canada is not the only country with deep-sea munitions sites. The U.S. and Austraila also have numerous deep-sea ordnance dump sites. U.S. Navy policy during the 40's and 50's authorized the dumping of ordnance at sea as a means of approved disposal. Ignoring input from the California Department of Toxic Substances (DTSC), the U.S. Army Corps of Engineers (USACE) Los Angeles District recently completed a time critical removal action (TCRA) at the Former Trabuco Bombing Range in Rancho Santa Margarita, California. The removal action involved the disposal of UXO including 3-lb miniature practice bombs discovered during construction of a recreational bike path.
The Trabuco Bombing Range was a historic range that was "operational" in the 1940's and 1950's. Since 1984, the area has been redeveloped for residential and recreational use. The former range is in the Formerly Used Defense Site (FUDS) Program managed by the USACE including the portion of the site that is now part of the O'Neill Regional Park.
Several months prior to the execution of the TCRA, the DTSC requested that the USACE modify the schedule of the project to allow time for them to complete their review of the planned removal activity for compliance with California Health and Safety Code and California Environmental Quality Act requirements. In a letter to the DTSC, the USACE explained that they declined to the delay the removal action because they were under the impression that the UXO at the Former Trabuco Bombing Range is not a "solid waste" and thus could not be considered a "hazardous waste". Therefore, they asserted that the UXO were not subject to DTSC regulations. The USACE cited the Munitions Rule which states that "military munitions is not a solid waste when...used for its intended purpose, including: ...Recovery, collection and on-range destruction of unexploded ordnance and munitions fragments during range clearance activities at active or inactive ranges."
The DTSC responded by educating the USACE on the formal DoD and statutory definition of an operational range which includes active and inactive ranges within DoD control. By definition, a FUDS is not in DoD control and is not an operational range. The DTSC asserted their position that UXO on Other Than Operational Ranges including FUDS is both a hazardous substance and a hazardous waste under State and federal laws. Furthermore, the state is considering enforcement actions against the USACE.
LIVERPOOL England U.K. - Children playing in the sand dunes at Merseyside Beach uncovered an unexploded WWII 4-inch bomb. Police called to the scene secured the area and called bomb disposal technicians. After their initial inspection, they decided to evacuate the entire beach. Hundreds of vacationing families were forced to cut their day at the beach short. A controlled detonation was carried out several hours later. No injuries were reported.
Fort Mclellan, Alabama - Last month, the Alabama Department of Environmental Management (ADEM) accused a UXO contractor working on Fort McClellan of hiding UXO instead of properly disposing the items. Reportedly the contractor concealed 13 mortar rounds behind trees, leaves and soil. The Army conducted an expanded search along 900 feet of roadway near where the items were found and located 11 more rounds. The rounds were determined to be practice rounds.
ADEM is requesting that the Army, reinvestigate all previously cleared areas. The accusations from ADEM and the subsequent finding of more UXO prompted Alabama Senator Richard Shelby (R) to write a letter to the Secretary of the Army recommending the Army take an immediate response to the issue. In the letter, the Senator states that the contractor's actions had "severely damaged the confidence of state regulators and the local community."

The body is loaded with an inert plaster filler. A black powder spotting charge (.55 lbs) is loaded in a cavity just below the booster casing of the fuze. |
